The regulation of peer-to-peer lending, and the application of the CCCFA to the industry, has been uncertain for some time. In a recent judgment from the High Court, the Commerce Commission has sought to have these matters clarified by the Court. While Harmoney was successful in challenging two of the questions put forward by the Commission, the Court has allowed the case to continue for the Court to opine on three remaining questions. The hearing, and any decision, is likely to be some time away. Whether clarification is achieved for Harmoney, or the industry as a whole, remains to be seen.Details
